Private Hire Agreement and Disclaimer for East Lothian Bouncy Castles & Entertainment Services

This Hire Agreement and Liability Disclaimer is for East Lothian Bouncy Castles and any persons hiring our Inflatables, Hire equipment or Entertainment services for Private Hire. Extended Hire Agreements & Terms of Hire for Commercial use, Public Events, Charity Events or School Events can be obtained by request in writing.

We Set-out these Terms & Conditions in Print format to distinguish the responsibilities & Liabilities of East Lothian Bouncy Castles our Staff/Representatives and You, the Hirer, for any damage or injuries occurring from or as a result of the misuse or reckless use of the Hired Items or services.

Persons using any hired items do so at their own risk.

These guidelines are for the safety of all persons using our hired items or services, and it is the sole responsibility of the hirer to ensure they are adhered to.

Our company cannot accept responsibility for any damage or injury to anyone using the equipment however caused.

We operate with £5m public liability insurance with a major UK insurer.

To extend our Cover of liability to you is a chargeable service and may be added to your order as a Bolt On to include our staff supervision package. Please ask for a a quotation.

IMPORTANT INFORMATION

General

1. Prior to hire, a safety check must have been completed by either the hirer or by an East Lothian Bouncy Castles & Entertainment representative, to ensure that the hired stock items is fully suitable for the area that it has to be erected in and the type of use that it has been hired for.

2. Full payment in cash on delivery or cleared funds prior to delivery is expected upon delivery and erection of the hired stock items. Non-payment may result in the refusal of a hire, cancellation of any bookings made and the retention of any deposit payments that have been taken, unless told otherwise in writing.

3. You the hirer are not only financially responsible for any loss or damage to the equipment on hire but also any injury occurring whilst the equipment is on hire to you unless otherwise stated in writing. We suggest that you check with your own Insurer that you have adequate cover in place to pay for any financial loss or damages raised by a claim against you.

4. All equipment should be checked on delivery; You the hirer must ensure that all items on hire from East Lothian Bouncy Castles & Entertainment are accounted for and returned to our collection staff in the same clean condition that they were delivered to you. Any damage to the equipment will be charged for. Equipment returned in a dirty condition may be liable for a cleaning charge starting at the rate of £50.00 per hour.

5. The hirer agrees that the area in which the inflatable is to be erected, and the area 1.5 metres around it will be completely free from debris including animal foul. If this is not the case when the inflatable is delivered, East Lothian Bouncy Castles & Entertainment reserves the right to refuse the hire. In this case payment will still be required and any Deposits are Non-Refundable.

6. Periodic checks are to be made during the hire time and use of the equipment provided. The equipment can move during your hire time and therefore these checks are very important. The periodic checks will be provided on a separate checklist. You are agreeing that this list has been received and that the checks will be carried out.

7. Our delivery driver is trained and authorised to setup and collect the hired equipment and under no circumstances is the equipment to be moved or handed over to anyone other than our delivery driver.

Safety

8. Do not allow anyone to be on the inflatable during the inflation and deflation as this can be very DANGEROUS.

9. If the inflatable is not being used for any part of the day, please switch the fan off at the mains.

10. Where the castle is a child’s castle, this will be designed for use by children no taller than the interior walls of the unit. The safe number of children on an inflatable at any one time depends on their size and weight. There must be enough space for each child to bounce freely without colliding with others. Adults should not enter a children's castle unless it is for safety reasons.

11. Ensure that participants are not pushing, colliding, fighting, or behaving in a manner that is likely to cause injury or distress to others. Ensure that children are not attempting somersaults, as this can be extremely dangerous.

12. Do not allow anyone to bounce or play on the front step of the inflatable as a child could quite easily bounce off and get hurt. The front step is there to assist the users getting on or off the inflatable. It is also a good idea to use one side of the step for entry and the other for exit.

13. Ensure that no one with a history of back or neck problems, or anyone who suffers from a heart complaint, or anyone who is Pregnant uses the inflatable. This is also the case for anyone who is feeling unwell or is suffering from the effects of alcohol or drugs.

14. Always ensure that the inflatable is not overcrowded, and limit the number of users according to age, size and stature of the participants using it. Different jump periods may need to be arranged to allow different age groups to use the inflatable at different times.

15. No Food or Drinks (including Chewing Gum & Sweets) is to be allowed near or on the inflatable. This will avoid choking and damage to the unit.

16. Shoes, Glasses, Jewellery, Badges, Toys, Sharp instruments including Zips or any Pets are not allowed on or near the inflatable. Please ensure that pockets are emptied prior to entering the inflatable.

17. No Face Paints, Party Poppers, Confetti, Pens, Pencils, Coloured Streamers, Glitter or Silly String is to be used on or near the inflatable.

18. No Smoking, Naked Flames, or barbecues to be near the inflatable.

19. Climbing, hanging, or sitting on the walls of the inflatable is extremely dangerous and must not be allowed.

20. A responsible adult must ALWAYS supervise the use of the hire equipment.

21. Never use an inflatable without the provided anchorage in place. Due to the amount of air being pumped into the inflatable it is not uncommon for the wind to move or blow it over with Wind Speeds more than 24 MPH. It can also move or topple over due to the boisterous activity within the inflatable.

Weather

22. Inflatables should not be used if the jumping area becomes wet as it will become very slippery and can cause injuries. In the event of rain, inflatables should not be used. Any Wet areas should be towel dry before reuse.

23. In the event of heavy rain, the fan should be switched off at the mains and covered with a plastic bag along with the extension lead. The inflatable should not be used. Any wetness on the bed of the inflatable, including bubbling (which is normal) can be dried off with a towel.

24. In high winds (Gusts of 24mph) the fan should be turned off and users are not permitted to use the Inflatable equipment until it is safe to do so. This will be determined by the Anemometor that is provided to you during setup.

Potential Issues

25. In the event, that the Fan Blower stops working, ensure all users are evacuated from the inflatable immediately. The fan should be connected via an RCD device at the power supply, so try pressing the reset button on the RCD device. Also check the fan to ensure it is clear from debris and nothing is blocking the fan intake. Please also check that the Strap attaching the Bouncy Castle to the fan has not become loose. Lastly change the Fuses of any electrical plugs relating to the powering of the Blower unit. After these checks have been performed and the fan is still not operational, contact East Lothian Bouncy Castles & Entertainment on 01875 813 282 or 07825 643 500 for advice.

26. In the event of the fan overheating or it loses power, switch off at the mains and leave for 5 minutes. Once switched back on again it should restart. If it does not refer to paragraph 25 in this document.

Cancellations

27. In the event of Adverse weather conditions including, but not limited to: Heavy Rain and/or Strong Winds a private hire may be cancelled by East Lothian Bouncy Castles at no charge to the customer. In the event of this type of cancellation the hirer may move the hire to another date depending on stock availability. Any other cancellation made out with 30 days of the hire date will require a 50% cancellation charge. Any cancellation made within 30 days of the hire date will require a 100% cancellation charge. Any deposit payments are Non-refundable but can be transferred to another date within the same hire season (6 months) subject to availability.

28. In exceptional circumstances the customer may have the ability to move the hire date, but this will need to be agreed in writing with East Lothian Bouncy Castles & Entertainment, with as much notice as is possible. Depending on the circumstances there may be a fee for this, and the required stock may not be available for the new date, but alternatives may be offered.

IMPORTANT NOTICE

Provided that the equipment is used in accordance with the above guidelines and conditions of hire, those using the hired stock items or services should do so safely. However, accidents can happen. East Lothian Bouncy Castles & Entertainment can accept no liability for injuries sustained or any other loss, howsoever caused, in the absence of the negligence of East Lothian Bouncy Castles & Entertainment or its employees/representatives or Sub Contractors.

As the equipment will be in the hirer’s possession and full control whilst in use rather than that of East Lothian Bouncy Castles & Entertainment/employess or it's representatives, any liability for injuries and/or other losses caused other than in the circumstances described above rests with the hirer.

Accordingly, it is strongly recommended that the hirer has adequate public liability insurance covering his or her liability arising from the use of the hired equipment or services.

  • I agree to the above Terms & Conditions of Hire

  • All equipment Hired will be returned in the same Condition as at the start of my Hire period

  • Loss or Damage to Any of the Equipment will be the Financial Responsibility of the Signee

It is imperative that we know about any Access Restrictions at the time of Booking to ensure that we have the correct manpower and equipment on the day of Hire. Access Restrictions Include but are not Limited to:

Steps or Stairs to Access the Area, Hills, Slopes, No Rear Access to a Property, Parking Restrictions, No Lift for Heavy Equipment going into Indoor Venues, Setup area’s further than 80 Ft away from our Delivery Vehicle
